Beyond Putt terms of use

These terms are an agreement between you and Biswa Games Pvt Ltd, Kolkata, India ("Biswa Games", "we", "us") for Beyond Putt - Create Your Own Mini Golf (the "Game"), including Creator Mode and community tracks. By playing the Game, and in particular by publishing a community track, you agree to these terms. If you do not agree, do not use the Game. If you are under the age of majority where you live, a parent or guardian must agree for you.

The Meta Horizon Store terms and Meta's own terms also apply, because the Game is sold and run through Meta. How we handle your data is explained in the Beyond Putt privacy policy.

1. Playing the Game

When you buy or download the Game, you get a personal, non-transferable licence to play it on your Meta Quest headset for your own entertainment. The Game, its pieces, courses, art, music, code and names belong to Biswa Games or its licensors. You may not copy, sell, rent, reverse-engineer or modify the Game, except where the law allows it regardless of these terms.

2. Community tracks belong to Biswa Games

Creator Mode lets you build holes from our pieces and publish them so other players can play them ("community tracks"). Drafts you have not published stay on your device and are yours. When you publish a track, the following applies:

Ownership. Every community track is built inside the Game with our tools and our pieces. You agree that each track you publish, including its layout, title and thumbnail image, belongs to Biswa Games. To the extent you have any rights in a track, you assign them to Biswa Games, worldwide and for the full duration of those rights, when you publish it.
Licence where an assignment is not possible. If the law that applies to you does not allow that assignment, you instead give Biswa Games a worldwide, perpetual, irrevocable, royalty-free licence, which we may transfer and sublicense, to use, copy, change, adapt, combine, publish, display and distribute the track in any form, for any purpose. This includes the Game and future versions, other games and products, biswagames.com, trailers, advertising, social media, press and events.
No payment. You will not be paid for a track or for any use of it.
Credits. We may credit you as the creator of a track by your Meta user name, for example in the Game, on biswagames.com, in trailers, posts or other material where we use the track. We are not bound to credit you, everywhere or at all, and leaving out or removing a credit does not affect our rights in the track. To the extent the law allows, you agree not to assert moral rights against our use of a track.
Other players. Every player can find, play, like and remix published tracks. A remix of your track, or of anyone else's track, is also a community track and belongs to Biswa Games on the same terms. It keeps a record of the track it came from.
Featuring. We may feature, rank, rename, crop, or show tracks as "Track of the week" or similar, in the Game and elsewhere.
Unpublishing. You can unpublish your own tracks at any time from My Tracks. An unpublished track is removed from the Game for other players. We may keep copies (for example in backups, for safety reviews or to resolve disputes). Remixes other players have already made, and uses we have already made (for example a trailer or a post), may continue.

3. What you may publish

By publishing a track you confirm that:

you built it yourself in the Game, or it is a remix made with the Game's remix feature;
its title and content contain no hate, harassment, sexual content, threats, spam or advertising;
its title does not include anyone's personal information, or names, brands or trademarks you have no right to use;
it does not break any law or anyone else's rights.

We may review, rename, hide or remove any track, and limit or stop anyone from publishing, at any time, with or without notice. Players can report a track; we act on reports at our discretion. Removal requests: see "Contact" below.

4. Fair play

You agree not to:

cheat, or use modified versions of the Game, bots or scripts;
fake likes or plays, or interfere with other players' tracks;
impersonate another player;
try to access, overload or interfere with our servers, the community-track service, or the data of other players.

We may suspend or end your access to community features if you break these terms.

5. Changes to the Game and the service

The Game is in development and community features may change. We may change, limit, suspend or stop Creator Mode, community tracks, likes, plays or any other feature, temporarily or permanently. Community tracks may be removed or lost (for example after a change of format). Keep your own drafts on your device if they matter to you.

6. No warranty and limits of liability

The Game and community tracks are provided "as is" and "as available". Tracks are made by players, not by us, and we do not check every track before it is published. To the extent the law allows, Biswa Games is not liable for indirect or consequential losses, or for loss of tracks or data. Nothing in these terms limits rights you have under consumer law that cannot be limited by agreement.

7. Law and disputes

These terms are governed by the laws of India, and the courts of Kolkata, West Bengal have jurisdiction, unless the consumer law of the country you live in gives you the right to bring a claim where you live.

8. Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change is significant, we will tell players in the Game or on this page. Continuing to play, or publishing a track, after a change means you accept it.
